All rights, including copyright, in this website are owned by or licensed to Performance Products Ltd. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Performance Products Ltd. You may not modify, distribute or re-post anything on this website for any purpose.

Accuracy of content:

Performance Products Ltd has taken every care in the preparation of the content of this website. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of VAT. Packaging may vary from that shown. Any weights, dimensions and sizes given are approximate only. We have made every effort to display as accurately as possible the colours of our products that appear on the website. Availability:

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available.

Ordering errors:

You are able to correct errors on your order up to the point at which you click on 'Confirm and Make Payment' on the final page of our ordering process.

Acknowledgment and acceptance of your order:

If you have supplied us with your email address, we will notify you by email as soon as possible to confirm receipt of your order and email you again to confirm details. Our acceptance of your order will take place upon despatch of the product(s) ordered.

Delays:

Occasionally, the despatch of your order may be delayed. This can be for various reasons such as material shortages, import delays or higher than anticipated demand. We will, of course, make every effort to keep you informed.

Cancellation right:

You will only be able to exercise this right if you are able to return to us the goods you ordered unworn, undamaged and with all original packaging as originally supplied.

Returns policy:

The customer is required to pay for postage of non-faulty returned items but postage on wrong/faulty returns will be refunded by Performance Products Ltd. Please give us at least 2 weeks to process your refund once we've received your goods. The refund will be credited to the payment card account and you should be notified by email once the refund transaction has been completed. We will endevour in all circumstances to refund your card within 24 hours of receipt of returned goods.

Payment terms:

All items must be paid for prior to the despatch of goods. Payment of goods can be made by credit or debit card and by cheque. If paying by cheque please make payable to Performance Products Ltd and allow 5 working days for the funds to clear before the goods can be dispatched.

Exclusions of liability:

Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Performance Products Ltd or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with English Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Our right to cancel orders:

If a payment address cannot be verified with the card issuer, then we may have no option but to cancel the order. To prevent this happening, always take care when entering your address into the payment system and always use your billing address as it appears on your statement. If for any reason we cannot verify your address or suspect you are not the rightful owner of the credit/debit card, we reserve the right to cancel your order.
